Licensed access is a licensing system whereby organisations or individuals who are suitable to instruct barristers because they have expertise in particular areas of the law can apply to the Bar Council to be licensed to instruct barristers directly in those areas. The licence can cover advice or representation or both and permit licensees to instruct barristers either on their own affairs or on behalf of their clients.

As a general rule, if your case falls into one of the following categories you should be able to instruct us:

  • You need legal advice
  • You need work carried out before court
  • You want to negotiate with the other side
  • The case involves points of law rather than fact
  • The case is not contentious at all, but requires advice or drafting.
  • You wish to appeal a decision
  • You may be involved in a hearing before a tribunal
  • You wish to avoid litigation altogether
  • You wish to engage in Mediation

We still work closely with many firms of solicitors in the cases which are not suitable for licensed access or will sometimes recommend the use of a solicitor for certain aspects of your case, such as issuing and serving claims, instructing experts, or interviewing witnesses.

To discuss the prospects of instructing our Barristers direct, feel free to contact our Senior Clerk on 0207 353 9412.
