Background

 

Before being called to the bar Jon enjoyed a successful career in IT in the City of London, working for Dresdner Kleinwort Benson (now Commerzbank) for six years and being promoted to Vice President. He was variously a software developer, project manager and business analyst

 

Whilst at Bristol University Jon was a member of the University Air Squadron where he learned to fly. He is the founder and president of the old members’ association and retains contacts throughout the military and airline industry

 

Practice

 

Jon now practices in all areas of Commercial and Chancery law

 

He has experience conducting trials on the Multi Track, Fast Track and Small Claims Track, including cross examination of expert witnesses; final hearings under Part 8; possession hearings; insolvency hearings, including winding up orders and annulling bankruptcy orders; interim hearings, applications and case management conferences. He also has wide experience drafting pleadings, settling witness statements, conducting round table conferences and other negotiations, and advising on a wide range of Commercial and Chancery matters

 

Recent cases have involved the following areas of law:

 

Commercial and Company

 

Commercial debt; limitation clauses; agreements to make parties shareholders, whether constructive trust arises; failure to perform and failure to pay; repudiatory breach of contract; Consumer Credit Act 1974; subcontractor's assumption of responsibility in building contracts; conditions precedent; sale of goods - sale under voidable title / sale by buyer in possession; restoration of companies to the register; Bills of Sale and mortgage of chattels; Charging Orders; commercial franchise agreements

 

Landlord and Tenant

 

Possession under the Housing Act 1988 and under the Common Law; termination and inheritance of Rent Act tenancies; service charges; Right To Manage companies; distinction between lease and licence

 

Estates and Trusts

 

Inheritance (Provision for Family and Dependants) Act 1975; deeds of variation of wills; the proper administration of estates under both wills and intestacies; insolvent estates; exercise of power of appointment and power to apply capital under a trust deed; applications under Variation of Trusts Act 1958; construction of wills; retirement and appointment of trustees; testamentary capacity

 

Land and Mortgages

 

Beneficial interest in property - Constructive Trust and Proprietary Estoppel, Trusts of Land; dividing up and raising money on the security of a development of flats; "wife and bank" cases - whether a constructive trust arises and whether this binds the husband's mortgagee; redemption of mortgage when mortgagee cannot be traced; adverse possession, including transitional provisions
